These General Online Sales Conditions (“General Conditions”) apply to all purchases made through this website.
Throughout the online purchase and sale process, all legally required pre-contractual information is available and which is also reproduced in these General Conditions.
When placing an order on the website, it enters into an electronic contract with CIMAI - Engenharia e Química Rápida, Unipessoal Lda., Headquartered at Travessa de São João, Lot 110 Serra Casal de Cambra 2605-192 Belas, registered at the Commercial Registry Office of Sintra under the unique registration number and tax identification number 501 872 043, with share capital € 610,000.00, e-mail (geral@grupo-cimai.com) and telephone 219 818 440 (working days 08H30 -13H00 and 14H00-17H30) (“CIMAI”) which is governed by the present General Conditions to which it expressly agrees to be subject as well as the Terms of Use of the CIMAI website and the CIMAI Privacy Policy.
CIMAI may change these General Conditions at any time and in its sole discretion, so you should consult the date of the last update to confirm the date on which it was last changed. Unless otherwise indicated, changes to these General Conditions take effect on the date of the last update indicated at the top of this page. Purchases made online are governed exclusively by the version of the General Conditions that are in effect at the time the order is placed, excluding any conditions previously available. Each time you place an order on the website, you are reaffirming your acceptance of the General Conditions that are in force at all times.
By clicking on "Place my order" and declaring that you have read and accepted the General Conditions for Online Sales, you present a binding offer to purchase the selected products or services. CIMAI will accept your proposal by confirming your order to the e-mail address you have indicated.
Online purchases through the website are reserved for adults.
CIMAI will not file the contract nor will it be accessible online in your account or register. The contract entered into will be governed by the General Conditions that are in force at the time the order is placed, which must be consulted before placing the order and will have to be expressly accepted to place the order.
To place an order through the website you can register or create an account but this is not mandatory, you must follow the following steps for the order to be successfully completed:
1. Select the desired items, to consult the respective characteristics, price and, when applicable, the safety data sheets and technical data sheets.
2. Add items to the shopping cart by clicking "Add to Cart".
3. Your shopping cart - Click on the shopping bag symbol to review the items you have selected, add others and make the changes you want. To proceed, click on the “Order” button.
4. Information - If you are registered or have an account on the website, you only need to confirm the data, such as shipping address, otherwise, you must fill in your data (name, email, email address) telephone number, tax identification number).
5. Shipping - then you must select whether you want to collect the items at CIMAI or have them sent to the delivery address you specified.

8. Order confirmation - As soon as you finish your order, you will receive an automatic email confirming receipt of the order with its description.
The description as well as the essential characteristics of CIMAI's products and the respective price are displayed next to each of the articles by clicking on each of the articles' images, and CIMAI can provide access to additional information about them and, where applicable, safety data sheets and technical data sheets. The information made available on the website does not exempt you from consulting the product label when receiving it and before using it.
The prices and charges for the products on the website are based on the time of publication and may be changed by CIMAI at any time and without prior notice. Despite the efforts made so that the information and content presented on the website are correct and current, including the price, there may be errors. In the event that an error is detected in the price of a product in which the Customer has placed an order, CIMAI will inform the Customer so that within 3 days, it confirms, in writing, whether it intends to maintain the order by paying the difference in price or cancel the order, in which case CIMAI will fully refund the amount paid within 30 days. In the absence of a response from the Customer, within the aforementioned period, CIMAI will proceed to cancel the order.
Prices are expressed in Euros and include VAT at the rate in force at the time, excluding shipping costs and any other applicable charges, unless otherwise stated.
The total amount indicated before completing the order by clicking on "Place my order" and making the respective payment includes the price as well as any shipping and delivery costs, which vary depending on the products to be delivered, the method and the delivery time. selected delivery.
Bank fees and other fees due due to the selected payment method are not included in the total amount indicated and will be borne by the Customer in accordance with the conditions agreed with the respective Banks or payment companies (eg Paypal) to which the CIMAI is totally unrelated.
The discounts and promotions announced on the website will have their own terms and conditions and are not covered by these General Conditions.
CIMAI currently only delivers products purchased online in mainland Portugal, thus excluding the Autonomous Regions of Madeira and the Azores.
Deliveries are made to the delivery address provided at the time of ordering and are assured by the carriers hired for this purpose by CIMAI.
The delivery time for products purchased online is from 2 business days to 30 days, after order confirmation by CIMAI and respective payment.
The responsibility for the products and the risk of loss or damage will pass to the Customer upon delivery.
CIMAI only processes orders after confirmation of the respective payment, so CIMAI cannot guarantee the availability of the items.
If any product ordered is unavailable, and after contacting the supplier to inquire about the possibility of replacing the missing item, CIMAI will contact the Customer if the delivery time or the price of the item changes and the order will only continue after express consent of the Client.
In case of absolute unavailability of stock of the ordered product, CIMAI may propose to the Customer the supply of a product of equivalent quality and price, if any, and in this case, the order will only continue after the express consent of the Customer.
In case of absolute unavailability of stock of the ordered product, and it is not possible to propose to the Customer any product of equivalent quality and price or if he has not given his express consent for the change of the order initially made, CIMAI will proceed to cancel the order and will reimburse all amounts paid, within a maximum period of 30 days from the date of knowledge of the unavailability of the product, with the return expenses being borne by CIMAI.

The instructions necessary to process the payments due are available on the website and/or in the order confirmation.
9.1. Scope
Only the Customer who is a consumer (natural person acting for purposes that do not fall within the scope of his commercial, industrial, artisanal or professional activity) has the right of free termination of the contract, within 14 calendar days, without the need for indicate any reason.
The period for exercising the right of free withdrawal expires 14 days from the day following the day on which you purchase or a third party appointed by you, other than the carrier, acquires physical possession of the goods or, in the case of being sent in parcels distinct from the last good.
In order to exercise your right of free withdrawal, you must inform us of your decision to terminate this contract by means of an unambiguous statement.
For this purpose, you can send a letter by mail to CIMAI - Engenharia e Química Executivo, Unipessoal Lda., Travessa de São João, Lot 110 Serra Casal de Cambra 2605-192 Belas or by e-mail to the following address geral@grupo-cimai.com. You may also, if you so wish, although this is not mandatory, use the model of the resolution form attached to these General Conditions.
The withdrawal period is considered to be respected if the communication of the withdrawal right is sent before the end of the 14-day period.
9.2. Effects of free resolution
In the event of termination of this contract, all payments made, including delivery costs, will be refunded without undue delay and, in any case, no later than 14 days from the date we are informed of your decision termination of this contract. We make these refunds using the same payment method you used for the initial transaction, unless expressly agreed otherwise by you; in any case, it does not incur any costs as a result of such reimbursement.
We can withhold the refund until we have received the returned products, or until you provide proof of shipment, whichever comes first.
You must return the products to the address identified above, without undue delay and no later than 14 days from the day you inform us of the free termination of the contract. It is considered that the deadline is respected if you return the products before the 14 day deadline. You must bear the direct costs of returning products.
It is only responsible for the depreciation of products resulting from handling that exceeds what is necessary to verify the nature and characteristics of the products.
If you wish to submit a complaint, the Customer may do so by e-mail geral@grupo-cimai.com, providing the details of contact, identify the product or service and provide all necessary information to clarify the complaint.
Whenever the Customer is a consumer (a natural person who acts for purposes that are not part of his commercial, industrial, craft or professional activity), he can also submit his complaint in the Electronic Complaints Book, under the terms of Decree-Law no. 156/2005, of 18 September.
All products sold through the website benefit from the legal guarantee provided for in the Civil Code, except when the Customer is a consumer (natural person who acts for purposes that do not fall within the scope of their commercial, industrial, craft or professional activity) in which case they will benefit of the legal guarantee applicable to consumer goods, under the terms set out in Decree-Law No. 67/2003, of 8 April, and in both cases, the warranty period starts from the date of delivery of the goods .
Failure to comply with this contract by either Party will give rise to civil liability under the general terms of the law.
The Client is responsible for the veracity and accuracy of the data communicated to CIMAI, undertaking to update or inform CIMAI of any changes to them. CIMAI declines any responsibility for any delay or impossibility of processing the order, including delivery, resulting from the incorrectness, inaccuracy or omission of the data communicated by the Customer.
CIMAI is not liable for indirect, incidental or consequential damages, including loss of profits and losses of economic benefits.
The total liability, whether by contract (including negligence) or by breach of legal duty or in any other way, of CIMAI, for any type of loss or damage that may result for the Client or third parties, regarding these General Conditions is limited the amount you paid for the product or service.
The exclusion and limitation of CIMAI's liability does not apply in the event of intent or serious guilt or damage caused to people's lives, moral or physical integrity or health or to non-contractual property damage.
Within the scope of online purchases made through the website, CIMAI collects and carries out operations for the treatment of personal data of Customers under the terms of the Privacy Policy, which is an integral part of these General Conditions.
The non-exercise or the late or partial exercise of any right that assists CIMAI under these General Conditions does not matter the waiver of that right nor prevents its subsequent exercise.
In the event that any provision of these General Conditions is declared void, or in any way invalid, this will not affect the validity of the other provisions of the General Conditions nor affect the validity of the contract, provided that the reduction of the deal thus operated does not affect the will to contract from each of the Parties on terms that determine that the contract would not have been concluded without the provisions affected by the eventual invalidity, in the applicable legal terms. The Parties shall replace the invalid or non-binding part with provisions that are valid and binding and whose effect, given the content and purpose of the contract, is as similar as possible to that of the invalid or non-binding part.
The present General Conditions will be governed and interpreted in accordance with the laws of Portugal, without prejudice to the conflict of laws rules, with the District Court of CIMAI's headquarters having jurisdiction, with express waiver of any other, to resolve any issue that may arise interpretation or execution of these General Conditions.
Without prejudice, whenever the Customer is a consumer (a natural person who acts for purposes that do not fall within the scope of his commercial, industrial, artisanal or professional activity), he can resort to one of the following Alternative Dispute Resolution Entities:
